Ghana NPP files Supreme Court suit over presidential term limits
The New Patriotic Party (NPP) has filed a lawsuit with the Supreme Court of Ghana seeking an interpretation of the 1992 Constitution regarding presidential term limits. The suit, filed by solicitor Godfred Yeboah Dame, names the Attorney-General as the defendant.
The NPP seeks declarations on Articles 58(2) and 66(1), (2), and (3)(a) to clarify whether the two-term limit applies to both consecutive and non-consecutive terms. The party argues that a person cannot be elected President more than twice or hold office for more than eight years in total. Additionally, the suit seeks clarification on the eligibility of a Vice-President who serves more than half of a predecessor’s unexpired term, requesting a declaration that such an individual is only eligible for one additional term.
Legal scholars and practitioners have responded to the filing with mixed views. Some, such as Kwaku Azar Asare and Austin Kwabena Brako-Powers, argue the suit is premature or constitutes a request for an advisory opinion rather than a resolution of a genuine constitutional dispute. Conversely, legal practitioner Martin Luther Kpebu noted that while the provisions appear clear, the NPP may be acting out of caution to prevent future legal ambiguity.
