Gibraltar implements new regulations for cross-border workers

New regulations for cross-border workers in Gibraltar have been implemented following the treaty between the United Kingdom and the European Union. The rules apply to European Union citizens residing legally in Spain who work in Gibraltar, including self-employed individuals.

A key requirement of the new framework is that cross-border workers must return to Spain at least once per week. To formalize their status, workers must obtain an annual certificate issued by the Director of Employment in Gibraltar. This certificate, which can be renewed, will be issued electronically via the eGovernment portal.

The regulations grant workers the right to enter, remain in, and leave Gibraltar for work purposes. They also gain access to employment services, job assistance, and protections regarding wages, labor conditions, social and fiscal benefits, trade union rights, and vocational training on equal terms with British citizens. While family members are covered under certain provisions, the regulations explicitly state that cross-border status does not grant any right to housing in Gibraltar.
