Gilmar Mendes criticizes TSE leadership following 2026 elections
Supreme Federal Court (STF) Justice Gilmar Mendes has criticized the leadership of the Superior Electoral Court (TSE) following the 2026 Brazilian elections. In a social media post, Mendes stated that those leading the body responsible for organizing elections are expected to maintain the posture of an equidistant referee as prescribed by the Constitution.
Mendes noted that while the TSE's collective body (colegiado) successfully ensured the dispute occurred within democratic rules, the stability of the institution should not need to be rescued or reconstructed during every election cycle. He specifically warned that “silences and hesitations are not neutral,” arguing that such omissions can lead to contradictory decisions and provide pretexts for those seeking to attack the integrity of the electoral system.
The 2026 election, which saw Luiz Inácio Lula da Silva defeat Flávio Bolsonaro, was marked by high political polarization and legal tensions. These included disputes over voting hours and allegations regarding the availability of public transportation in various cities. While Mendes did not name specific individuals, his comments were widely interpreted as directed at the TSE presidency, currently held by Kassio Nunes Marques.
