Goiânia waste tax case heads to court ruling, could end municipal garbage fee

The Tribunal de Justiça de Goiás (TJGO) has scheduled a hearing for 26 August on a Direct Action of Unconstitutionality (ADI) that challenges the municipal waste collection fee (Taxa de Limpeza Pública) imposed in Goiânia. The ADI, filed in December 2024 by councilwoman Aava Santiago, argues the tax violates the Constitution due to lack of technical studies, disproportionate charges, and unclear valuation criteria. The state Public Prosecutor's Office supports the claim, and the court’s Special Body will decide whether the fee, introduced in 2026 to fund solid waste services, can continue.

If the court rules the tax unconstitutional, the decision could affect thousands of Goiânia residents who currently see the charge on their water bills, marking a significant moment in the city’s fiscal and environmental policy.

Separately, the National Council of Justice (CNJ) has ordered the same court to respond within five days to a separate lawsuit questioning the compulsory retirement of a magistrate, a matter unrelated to the waste‑tax case.
