Goiás court recognizes dual maternity for child conceived via home insemination

A court in Rio Verde, Goiás, has officially recognized the dual maternity of a child conceived through home artificial insemination by a female couple. Judge Coraci Pereira da Silva, of the 2nd Family and Succession Court, ruled that the child's birth certificate must include the names of both mothers without distinction.

The couple, who have been together since 2019 and married in May 2023, utilized genetic material from a known donor who signed a waiver of paternity. Because the procedure was performed at home rather than in a specialized clinic, the child was initially registered only under the name of the gestational mother.

The judge based her decision on the Civil Code regarding socio-affective filiation and Supreme Federal Court precedents regarding affective bonds. In her ruling, the magistrate included an original poem emphasizing that the best interest of the child is the absolute guide for justice. The Public Ministry of Goiás expressed support for the request.
