Google loses liability shield for AI Overviews in Munich court ruling

The Munich Regional Court I issued a landmark judgment on 28 May 2026, holding that Google’s AI Overviews are not merely search result snippets but independent content. The court therefore removed Google’s host‑provider immunity under German law. A preliminary injunction bans the company from repeating AI‑generated false statements about two German publishing houses, with penalties of up to €250,000 per violation.

The ruling rests on three grounds: the overviews are phrased in Google’s own words, they contain factual claims that do not appear in any source, and the EU AI Act classifies such outputs as the provider’s own content. Legal experts say the decision could reshape liability for generative‑search services across Europe, affecting publishers, retailers and Google’s AI‑driven search business.
