Google wins dismissal of antitrust lawsuit over AI Overviews
A U.S. federal judge has dismissed an antitrust lawsuit filed by Penske Media Corp and Chegg against Alphabet, the parent company of Google. The plaintiffs alleged that Google’s ‘AI Overviews’ feature used their content without authorization to generate summaries directly on search result pages, thereby reducing user clicks and traffic to the original websites.
Penske Media, which owns publications such as Rolling Stone and Variety, and the education platform Chegg argued that Google leveraged its dominant market position to force publishers to provide content for free, harming their advertising and subscription revenues. They claimed this created an ecosystem where creators lacked bargaining power.
U.S. District Judge Amit Mehta ruled that while the economic challenges faced by publishers are significant, they do not constitute a violation of antitrust laws. The judge stated that the plaintiffs' expectations—that providing free content would guarantee search traffic—do not constitute a legal agreement. Mehta concluded that addressing these economic shifts is a matter for the legislature rather than the courts.
