Greece implements new primary residence protection and auction reforms
Greece is implementing significant regulatory changes regarding auctions and the protection of primary residences. Starting September 1, 2026, a new electronic platform will allow for the re-determination of stays of execution. This process aims to resolve approximately 36,500 pending cases, including 33,000 in the Athens Court of First Instance, which involve court decisions scheduled from September 2027 through 2039.
Additionally, a new regulation effective September 21, 2026, introduces a mechanism for debtors to separate their primary residence from their remaining assets. This allows for greater debt relief and lower monthly installments. Under this system, an algorithm calculates debt reductions based on the value of the primary residence relative to total debt. While the primary residence is preserved, other assets are liquidated through electronic auctions (e-auctions) to satisfy creditors. Debtors retain the right to accept or reject the algorithm-generated proposal.
