Greek olive oil mill avoids tax penalty after dispute resolution
The Directorate for Dispute Resolution (DED) has overturned a tax penalty imposed on an olive oil mill in Kalamata, Greece. The dispute originated from a January 2024 audit by the Kalamata Tax Office, which identified a significant discrepancy between the olive oil recorded in the company's books and the physical stock found in its tanks.
Initially, auditors reported a difference of nearly 50 tons, with an estimated value of approximately 374,000 euros. Following explanations from the business, the discrepancy was adjusted to 48,928 kilograms, valued at 366,963 euros. The tax authorities had imposed a fine on the grounds that the oil was purchased from producers without the necessary documentation or invoices.
The company challenged the fine through the DED, arguing that the initial stock calculations used by the tax office were incorrect. The DED ultimately ruled in favor of the business, noting that when tax authorities impose penalties for the non-issuance of tax documents, they must specify exactly which documents were missing and provide concrete evidence of the violation. The ruling stated that conclusions based on approximations are insufficient for such penalties.
