Guatemala TSE avoids stance on CSJ ruling regarding PAN
The Supreme Electoral Tribunal (TSE) has declined to take a formal stance regarding a decision by the Supreme Court of Justice (CSJ) to keep the Partido de Avanzada Nacional (PAN) active. Despite failing to secure the minimum 5% of votes for a presidential ticket or any seats in Congress during the last election, a CSJ resolution has provided a provisional injunction that prevents the party's definitive cancellation.
Magistrate Mario Alexander Velásquez Pérez stated that the TSE cannot issue an opinion on a case it is tasked to oversee, noting that similar court rulings often establish jurisprudence. The TSE has appealed the CSJ's decision, leaving the final determination regarding the political organization's future to the Constitutional Court (CC).
TSE President Rosa Mariella Rivera emphasized that the tribunal will respect all injunctions and resolutions issued by the courts, maintaining that the body must abide by judicial orders.
