The Department of Homeland Security (DHS) has acknowledged the death of Jose Chajon-Raxon, a Guatemalan immigrant who had been detained at the Delaney Hall facility in Newark, New Jersey. Chajon-Raxon was processed into custody on July 18 and experienced a seizure-like medical emergency the following day. While he was treated by medical staff and subsequently released from ICE custody on July 22, he died following his hospitalization.

DHS stated that ICE was not notified of the death because, under current policy, the agency is not responsible for monitoring or reviewing deaths that occur after an individual is no longer in its custody. This follows a policy reversal where ICE rescinded a 2021 Biden-era rule that required the agency to notify Congress and investigate deaths occurring within 30 days of a detainee's release.

U.S. Representative Rob Menendez criticized the policy change, arguing it creates a loophole that allows the agency to avoid public scrutiny and accountability. The Delaney Hall facility, which is privately operated, has previously seen the deaths of detainees from El Salvador and Haiti, drawing scrutiny from human rights advocates and lawmakers.
