Guillermo Martín Moncayo faces 54 months of detention without conviction

Lawyer Guillermo Martín Moncayo von Hase has been held in preventive detention for 54 months in Buenos Aires province without a conviction. Originally accused in 2022 of sexual offenses within a family context, Moncayo underwent an oral trial marked by alleged irregularities, including the denial of decisive evidence and improper jury instructions.

Although a 2024 conviction was annulled in late 2025 following an appeal, provincial judges have denied his release. Critics argue this prolonged detention violates the principle of innocence and constitutional norms regarding reasonable timeframes for judicial processes. There are also allegations that the initial accusations may have been unfounded and linked to divorce proceedings.
