Gun rights groups sue New Mexico over firearm waiting period

Pro-Second Amendment organizations have filed a lawsuit against New Mexico, alleging the state is defying a federal appeals court ruling. The National Shooting Sports Foundation, National Rifle Association, Second Amendment Foundation, and the New Mexico Shooting Sports Association claim the state is circumventing a Tenth Circuit decision that struck down the state’s firearm purchase waiting period as unconstitutional.

New Mexico officials have maintained that the ruling, which granted summary judgment, applies only to the specific individuals involved in the original case. State representatives stated that the law remains in effect for others until a court mandates otherwise. The plaintiffs are seeking an order to declare the law unconstitutional for all individuals and to enjoin the state from enforcing it against customers and members.
