Gustau Muñoz family seeks reopening of 1978 murder investigation

The family of Gustau Muñoz has filed a legal request in Barcelona to reopen the investigation into the 1978 killing of the 16-year-old Communist Party activist. The case, which was provisionally archived in October 1983, is being challenged by lawyer Benet Salellas on the grounds that the murder constitutes a crime against humanity and therefore is not subject to statutes of limitations.

The new legal filing cites five new witnesses and additional documentation that implicate two National Police inspectors, Francisco Martínez Menéndez and José Luis Varela Miras, as potential perpetrators. The incident occurred during a police charge in Barcelona on September 11, 1978.

Legal representatives argue that because the killing took place during the final stages of the Spanish Transition—after the 1977 Amnesty Law but before the 1978 Constitution—it falls under the jurisdiction of the 2022 Democratic Memory Law. This law aims to overcome previous legal obstacles to investigating serious human rights violations from the Franco era.
