Hague rulings refute claims of equal guilt in Balkan conflicts

Murat Tahirović, president of the Association of Victims and Witnesses of Genocide, argues that Hague tribunal rulings refute political narratives of 'equal guilt' among parties in the former Yugoslavia. He emphasizes the legal distinction between a Joint Criminal Enterprise (JCE) and command responsibility.

According to Tahirović, the JCE is a tool used to prove systemic, institutional crimes involving a coordinated plan to forcibly remove entire populations. In contrast, command responsibility focuses on a superior's failure to prevent or punish crimes they became aware of. He notes that the leadership of the Republic of Bosnia and Herzegovina and its Army were never convicted by international courts for JCE or genocide.
