Hamburg court rules on highway merging liability
A Hamburg District Court (Landgericht Hamburg) has issued a ruling regarding liability during highway merging, specifically in scenarios involving traffic congestion. The case involved a collision between two trucks after a traffic jam cleared.
The dispute centered on whether a merging maneuver was complete. One driver argued that the maneuver was finished because the vehicle had been stationary in the new lane for several minutes. However, the court ruled that the merging process was not officially complete because a portion of the vehicle, specifically the rear right wheel, still remained on the acceleration lane.
Consequently, the court determined that the merging driver must yield priority to vehicles on the main lane until the vehicle has fully straightened and exited the acceleration lane. The German automobile club ADAC highlighted the importance of this decision for road safety and legal clarity.
