Hanuman Beniwal granted interim relief by Rajasthan High Court
The Jodhpur Bench of the Rajasthan High Court has granted interim relief to Nagaur MP Hanuman Beniwal regarding an FIR registered at the Kuchera police station in Nagaur district. Justice Farjand Ali directed that no coercive action be taken against Beniwal while the court considers his petition challenging the proceedings.
The case stems from a political rally held in Kuchera during the 2024 Lok Sabha elections. An FIR was filed on May 4, 2024, following a complaint by Sub-Inspector Mukesh Kumar, alleging violations of prohibitory orders. The charges include unlawful assembly, disobedience of orders promulgated by a public servant, and causing obstruction or danger in a public way under various sections of the Indian Penal Code.
During the hearing, Beniwal’s legal counsel argued that the gathering was a peaceful political protest and noted there were no allegations of violence or property damage. The High Court observed that peaceful protest is a component of democratic rights. The court has requested responses from the Rajasthan government and police authorities, scheduling the next hearing in three weeks.
