Harish Salve criticizes Kapil Sibal over judiciary comments

Former Solicitor General Harish Salve has criticized senior advocate and Rajya Sabha MP Kapil Sibal regarding Sibal’s recent statement expressing a loss of faith in the judiciary. Salve argued that there is a distinction between being disappointed by a specific ruling and losing trust in the judicial institution itself.

Salve noted that while Supreme Court decisions are final even if they are perceived as incorrect, claiming a loss of faith suggests that the judiciary is intentionally delivering wrong judgments. He advised that if an advocate truly lacks faith in the courts, they should advise their clients accordingly, as he personally would not appear in court without such trust.

Addressing the Indian National Congress’s ongoing questioning of constitutional bodies like the Election Commission and the judiciary, Salve emphasized the importance of not weakening institutional frameworks. He stated that regardless of which political party is in power, the stability of governance depends on maintaining public trust in the judiciary, legislature, and the elected executive.
