Herman Krause stuck in Brazil after provisional custody ruling blocks return to Argentina

A Brazilian federal judge granted Argentine father Herman Krause provisional custody of his two sons, Paco and Mateus, after determining they had been taken illegally across the border. The same decision recommended that another court review the ruling, leaving Krause unable to return to his home in La Plata.

Since early July, Krause has been living in São Paulo, renting a house and halting his work, which he says has caused significant economic hardship. He has appealed for urgent intervention from Argentine diplomatic authorities, arguing that the judge's suggestion is not backed by any law and is preventing him from reuniting with his children. Krause also noted that prior accusations of family violence in Argentina were dismissed for lack of evidence.

He emphasized the need for his international‑law specialist lawyer to accelerate the process, while the mother remains abroad with the children. Krause’s case highlights the complexities of cross‑border family law and the limited recourse available when judicial decisions require further review.
