High Court annuls four provisions of Palma's General Plan
The High Court of Justice of the Balearic Islands (TSJIB) has annulled four specific provisions within the General Plan of Palma that were approved in April 2023. The ruling follows an appeal by Vibelba S. L. U. and Agropecuaria Mallorquina S. A., which argued that certain planning determinations did not comply with the law.
One significant error involved a plot of land where the General Plan incorrectly identified a 1,424-square-meter municipal water tank that did not exist. Although the Palma City Council acknowledged this error during the processing stage, the mistake was not corrected in the final approved documents.
Additionally, the court addressed the classification of certain areas in Son Quint as Natural Forest Interest Areas. The TSJIB clarified that because these errors are specific and territorially identifiable, the entire General Plan does not need to be annulled, only the four affected determinations.
