High Court in Podgorica rejects Metropolitanate's appeal against Basic Treaty

The High Court in Podgorica has upheld a previous ruling rejecting an appeal by the Metropolitanate of Podgorica and Montenegro. The Metropolitanate had sought to declare the Basic Treaty, signed between the State of Montenegro and the Serbian Orthodox Church (SPC) on August 3, 2022, null and void.

The court dismissed the claims of religious discrimination and sought damages, ruling the appeal unfounded. Furthermore, the court clarified that regular courts do not have the jurisdiction to determine the legality of the treaty, noting that such authority rests solely with the Constitutional Court.

The Metropolitanate had argued that the treaty would prevent it from serving in more than 40 Orthodox facilities. Following the finality of the verdict, the Metropolitanate is required to pay 450 euros in legal costs to both the State of Montenegro and the Serbian Orthodox Church.
