High Court of Cassation and Justice grants judicial experts appeal rights for fees

The High Court of Cassation and Justice (ÎCCJ) has ruled that judicial experts have the right to appeal decisions regarding the increase of their fees. Through Decision no. 87/2026, the court clarified the procedural status of experts when their compensation is being discussed.

According to the ruling, although a judicial expert may not be an original party to a litigation, they acquire a specific procedural interest when filing a request for a fee increase. The court determined that the determination of these fees is not merely an administrative measure, but a matter in which the expert has a direct interest. This decision is mandatory for all courts and interprets Article 458 of the Civil Procedure Code, ensuring that experts can exercise legal recourse against decisions affecting their professional remuneration.
