High Court orders prosecution for forged medical certificate

The High Court of J&K and Ladakh has ordered the prosecution of a former employee of the J&K State Road Transport Corporation for allegedly using a forged medical certificate during legal proceedings. Justice Sanjay Dhar dismissed a writ petition filed by the former employee, Bashir Ahmad Ganai, ruling that a litigant who relies on fraudulent documents cannot claim discretionary protection under Article 226 of the Constitution.

The case involved a dispute over service benefits and periods of absence. Ganai had presented a medical certificate purportedly from the Government Psychiatric Diseases Hospital in Srinagar to justify his absence from duty. The court characterized the use of the forged document as a serious abuse of the judicial process and directed the Registrar Judicial in Srinagar to lodge a criminal complaint against him before the Court of the Chief Judicial Magistrate.
