High Courts issue rulings on election and leadership petitions in Uganda and Kenya

In Uganda, the High Court in Mpigi has dismissed an application by Mawokota County North parliamentary petitioner Kiyaga Hillary Innocent. Kiyaga sought to compel his rival, Kyambadde Amelia Anne, to produce declaration of results forms from 37 polling stations. Justice Jamson Karemani K. ruled that the petitioner failed to prove Kyambadde possessed the disputed documents, characterizing the request as a ‘fishing expedition’. The main election petition challenges Kyambadde’s victory in the January 15, 2026, election, where she won by a margin of 2,274 votes.

In Kenya, the High Court has ordered that the petition challenging the appointment of Deputy President Kithure Kindiki and the impeachment of his predecessor, Rigathi Gachagua, be held via open, physical hearings rather than virtual sessions. A three-judge bench at the Milimani Law Courts in Nairobi granted the application to move the proceedings to a physical courtroom to ensure the petitioner’s right to a fair and public hearing. The hearing is scheduled for November 4 and 5, 2026.
