Hims & Hers faces FTC lawsuit and investor litigation over privacy

Telehealth company Hims & Hers Health Inc. is facing legal challenges regarding its data privacy practices and subscription models. The company has filed a motion to dismiss a lawsuit brought by the Federal Trade Commission (FTC), which was joined by Utah and Los Angeles County. The FTC alleges that Hims shared sensitive consumer health data—related to conditions such as obesity, hair loss, and erectile dysfunction—with advertising platforms including Meta and Snap.

The FTC further claims that the company misled consumers by charging for prescriptions shortly after intake forms were submitted, despite marketing suggesting users would first consult a provider. Additionally, the agency alleges that the company made the subscription cancellation process unnecessarily difficult. Hims & Hers has argued that its privacy policy explicitly states that personal information may be provided to marketing partners and that the FTC has misapplied federal law.

Separately, a proposed securities class action has been filed in the Northern District of California. This litigation challenges statements made by Hims regarding protections for personal health information. Investors who acquired securities between August 4, 2025, and July 29, 2026, have until November 2 to seek lead-plaintiff status in the case.
