Ho Chi Minh City Social Insurance clarifies early retirement rules for cancer patients

The Ho Chi Minh City Social Insurance office has provided guidance regarding social insurance benefits for individuals diagnosed with cancer who wish to seek early retirement or a one-time lump-sum withdrawal.

Under the Law on Social Insurance No. 41/2024/QH15, employees with at least 15 years of compulsory social insurance contributions may be eligible for a pension if they meet the retirement age requirements. For those with reduced working capacity, the law allows for early retirement under specific conditions:

- Individuals with a working capacity reduction between 61% and under 81% may retire up to 5 years earlier than the standard age. - Individuals with a working capacity reduction of 81% or higher may retire up to 10 years earlier than the standard age.

To apply for a pension, claimants must provide their social insurance book, documentation confirming the termination of their labor contract, and a medical assessment report from a medical examination council regarding their level of reduced working capacity.
