Homa Bay County ordered to disclose headquarters project records
The Commission on Administrative Justice (CAJ) has issued two rulings ordering the Homa Bay County Government and the County Assembly to disclose information regarding the construction of a new county headquarters. The decision follows a failure by the institutions to respond to a formal information request submitted in March 2025.
The requested documentation includes project approvals, the implementation status, and details regarding a lease-to-own financing arrangement with the County Pension Fund (CPF). Additionally, the ruling requires the disclosure of national government approvals, financial obligations, and reports on contingent liabilities.
The County Assembly has been directed to release certified Hansard records, relevant legislation, committee records, and financial reports. The CAJ clarified that while legally exempt information may be redacted, the institutions are bound by Article 35 of the Constitution and the Access to Information Act, 2016, to provide accessible portions of the records.
