Hong Kong proposes criminalizing building maintenance tender collusion

Following an independent inquiry into the deadly Wang Fuk Court fire, the Hong Kong government has proposed criminalizing bid-rigging in large-scale building maintenance and renovation tenders. The proposal includes amending the Competition Ordinance to allow for prison sentences of up to 10 years and fines of up to HK$10 million, or higher based on commercial gains and turnover.

To combat organized crime networks, the government intends to include these offenses under the Organized and Serious Crimes Ordinance. This will grant law enforcement powers to trace fund flows, freeze assets, and confiscate criminal proceeds, aiming to strip the economic incentives from collusion.

A multi-agency task force will be established under the leadership of the Secretary for Security. This task force will integrate the investigative capabilities of the Hong Kong Police Force, the Independent Commission Against Corruption (ICAC), and the Competition Commission to target the masterminds behind complex bidding networks.
