Santi Mina sentenced to four years in prison for sexual abuse

The Spanish Supreme Court has definitively confirmed a four-year prison sentence for footballer Santi Mina for the crime of sexual abuse. The incident took place in July 2017 in a van parked near a nightclub in Mojácar, Almería, while Mina was a player for Valencia CF.

The court's ruling rejected the defense's argument that the player acted under a 'vencible error' regarding the victim's consent. Magistrates concluded that Mina took advantage of the victim's proximity and the element of surprise to perform two non-consensual sexual acts, stopping only when he realized that continuing would require the use of force.

The ruling also maintained the acquittal of fellow footballer David Goldar, who was investigated alongside Mina. Additionally, the court rejected an appeal from the victim to increase the sentence to eight years, citing a lack of evidence regarding the use of instrumental violence. The victim's financial compensation was set at 25,000 euros.
