HoREA proposes Land Law amendments for certificate revocation

The Ho Chi Minh City Real Estate Association (HoREA) has submitted several proposals regarding the draft amendments to the Land Law. One key recommendation is to allow the State to revoke or cancel issued land use certificates in cases where land plots are destroyed by objective causes and the user is unable to restore the land to its original state.

HoREA also advocates for maintaining specific regulations regarding the subdivision and consolidation of land plots. The association argues that current draft provisions do not sufficiently cover the high demand from households and individuals for these procedures. They suggest adding a dedicated article to ensure legal grounds for land management and user rights.

In separate regulatory matters, the Ministry of Natural Resources and Environment addressed inquiries regarding compensation for mixed-use land where residential positions are not clearly specified in certificates. Additionally, industry representatives have raised concerns regarding the draft decree on petroleum business, calling for more specific regulations to prevent market disruptions and ensure retail businesses can operate effectively.
