Hospital in Arapiraca ordered to pay R$ 210,000 for baby swap

A court in Arapiraca, Alagoas, has ordered the Hospital Regional Nossa Senhora do Bom Conselho to pay R$ 210,000 in compensation following a 2022 incident where two babies were swapped in the maternity ward.

The ruling, issued by the 1st Court of the Comarca, allocates R$ 180,000 to the two affected families and R$ 30,000 for collective moral damages. The hospital has 60 days to implement new newborn identification protocols to prevent future occurrences. Failure to comply may result in a daily fine of R$ 1,000, capped at R$ 100,000.

The lawsuit was brought by the Public Ministry of Alagoas (MPAL) through the Prosecution Office of Childhood and Youth of Arapiraca. Prosecutors stated the decision serves as a necessary lesson for maternity units to ensure professional rigor and prevent family suffering.
