Hospital Universitario de Badajoz staff face trial for unauthorized medical data access

A nurse and a clinical assistant from the Hospital Universitario de Badajoz are facing trial before the Audiencia Provincial for allegedly accessing the clinical data of a married couple without consent. The victims are friends of one of the accused, and they had previously filed a report regarding a suspected drug-facilitated crime involving a partner of the nurse.

According to the prosecution, the two public officials used the Jara system of the Servicio Extremeño de Salud (SES) to access medical records on two separate days in August 2023. The unauthorized access included reviewing laboratory results related to the victims' previous reports of being administered narcotics. The prosecution also alleges that the information obtained was disclosed to third parties without authorization.

The public ministry has classified these actions as a crime of discovery and revelation of secrets. They are seeking a sentence of three years in prison, a six-year absolute disqualification from their professional duties, and 3,000 euros in compensation to each victim for moral damages.
