Hradec Králové council decisions face legitimacy concerns
The Hradec Králové city council faces questions regarding the legitimacy of its recent decisions following the expiration of official mandates. During a session on September 29, the council approved 63 items, including the transfer of a pond area valued at 64 million CZK to the company Městské lesy Hradec Králové, as well as various subsidies and budget changes.
A legal discrepancy has emerged because the council met five days after the constitutional end of its mandates. While the Ministry of the Interior suggested that municipal representatives remain in office until the next elections based on the Act on Elections to Municipal Councils, critics argue this contradicts the Constitution, which strictly defines the electoral period as four years.
Because the transfer of real estate and the provision of gifts require valid council consent, the legality of these resolutions could be challenged in court. This issue potentially affects other municipalities that held sessions after September 24.
