Human rights groups sue Trump administration over ICC sanctions
Four prominent human rights organizations—Human Rights Watch, the American Friends Service Committee, the Center for Constitutional Rights, and the Open Society Institute—have filed a lawsuit in the Southern District of New York against the Trump administration. The legal challenge targets a February 2025 executive order that authorized sanctions against officials, judges, and prosecutors of the International Criminal Court (ICC).
The plaintiffs argue that these sanctions constitute a “blatantly illegal attack on international justice” and impede the prosecution of war crimes and crimes against humanity. They assert that the measures violate First and Fifth Amendment rights under the US Constitution and the Religious Freedom Restoration Act by forcing civil society groups to curtail legal work. The sanctions were largely prompted by ICC investigations into potential crimes committed in Gaza involving Israeli officials.
In addition to targeting ICC personnel, the US sanctions also affect a United Nations human rights expert and three Palestinian rights groups. While the State Department has previously characterized such efforts as preventing “ICC overreach,” the lawsuit seeks to strike down the sanctions regime to ensure access to justice for victims of grave international crimes.
