Human rights groups sue Trump administration over ICC sanctions
Four major U.S. human rights organizations—Human Rights Watch, the Open Society Institute, the American Friends Service Committee, and the Center for Constitutional Rights—have filed a lawsuit in the Southern District of New York against the Trump administration. The legal challenge targets a February 2025 executive order that authorizes sanctions against officials, judges, and prosecutors of the International Criminal Court (ICC).
The plaintiffs argue that the sanctions regime is unconstitutional, exceeding presidential authority and violating First and Fifth Amendment rights, as well as the Religious Freedom Restoration Act. They contend that the measures create a chilling effect, forcing organizations to curtail legal research, advocacy, and cooperation with the Hague-based tribunal regarding investigations into genocide, war crimes, and crimes against humanity.
The administration’s actions follow ICC arrest warrants issued for Israeli Prime Minister Benjamin Netanyahu and former Defense Minister Yoav Gallant. The U.S. and Israel are not members of the ICC and reject its jurisdiction. Additionally, the sanctions target a UN human rights expert and three Palestinian rights groups. Secretary of State Marco Rubio has previously advocated for a campaign to dismantle the ICC by pressuring member states to withdraw.
