IBBI rules it cannot be forced to compile new data under RTI Act

The First Appellate Authority of the Insolvency and Bankruptcy Board of India (IBBI) has ruled that the Right to Information (RTI) Act, 2005, does not require public authorities to generate new datasets.

In a decision regarding an appeal by Goutam Mohanta, First Appellate Authority Shiv Anant Shanker held that the IBBI is not obligated to compile fresh data or analyze existing records in a format different from how they are currently maintained. The request sought information concerning Corporate Insolvency Resolution Processes (CIRPs), liquidation processes, creditor recovery, and haircuts.
