ICA Gruppen drug testing policy under investigation by Swedish privacy authority
The Swedish Authority for Privacy Protection (Integritetsskyddsmyndigheten) is investigating ICA Gruppen’s practice of requiring drug tests for all job applicants. The policy applies to all roles, including those in stores, warehouses, and at the corporate headquarters, regardless of whether the position involves safety-sensitive tasks like operating heavy machinery.
ICA defends the practice as necessary to maintain a drug-free and safe working environment. However, the Swedish Trade Confederation (Handels) has criticized the general testing as an infringement on personal integrity. Legal experts note that the legality of such tests often depends on a balancing of interests between an employer’s need for safety and an employee’s right to privacy.
The upcoming decision by the privacy authority is expected to serve as a precedent for how other employers handle biological data and drug testing in the recruitment process.
