ICE faces legal challenges over polling place enforcement and detention powers

The Trump administration is facing two significant legal setbacks regarding its immigration enforcement policies. In one case, the City and County of Denver, alongside advocacy groups such as the League of United Latin American Citizens, Common Cause, and UnidosUS, has filed a lawsuit in the U.S. District Court for the District of Columbia. The suit seeks to prevent Immigration and Customs Enforcement (ICE) agents from conducting enforcement operations at polling locations during the upcoming midterm elections, citing a Civil War-era statute that prohibits federal officials from bringing armed men to election sites.

In a separate ruling, the Fourth Circuit Court of Appeals issued a 2-1 decision regarding detention policies. The court rejected the government's attempt to implement mandatory detention without bond hearings for immigrants who have resided in the United States for extended periods, regardless of their initial entry status. These legal challenges raise questions regarding the extent of executive authority in immigration enforcement under existing federal law.
