Ikea wins legal ruling at European Court of Justice against Belgian party

The European Court of Justice (ECJ) has ruled in favor of the Swedish furniture retailer Ikea in a trademark dispute against the Belgian far-right party Vlaams Belang.

The dispute originated in November 2022, when Vlaams Belang used 'IKEA' as an acronym for its immigration reform program, 'Immigratie Kan Echt Anders' (Immigration Can Actually Be Different). The party also utilized graphic design elements reminiscent of Ikea’s brand, including assembly-style instructions to present 15 political proposals.

While the political organization argued that its use of the name was protected under the right to freedom of expression, the ECJ judges determined that the party's actions could potentially impair the trademarks and interests of the furniture company. The court found that the political interests did not outweigh the brand protections. The ruling provides guidance for Belgian courts, which will ultimately make the final decision in the specific case based on these ECJ principles.
