Ilhota municipality ordered to pay damages after daycare medical neglect
The municipality of Ilhota has been ordered by the 2nd Civil Court of Gaspar to pay R$ 10,000 in moral damages following a medical emergency involving a child at a municipal daycare center. The child suffered an allergic reaction after consuming cow's milk, resulting in swelling and redness.
According to the court ruling, the institution failed to provide immediate medical assistance or contact emergency services when symptoms appeared. Medical help was only sought after the child's guardians arrived at the facility. While court records indicated no known allergies on the child's registration forms, the judge ruled that staff had a duty to summon emergency services and notify family members immediately upon the onset of symptoms. The total indemnity consists of R$ 5,000 for the child and R$ 5,000 for the guardian.
