Income Tax Department issues ICDS guidance and dispute resolution frameworks

The Income Tax Department has released a guide detailing ten Income Computation and Disclosure Standards (ICDS) designed to standardize taxable income calculations and minimize litigation. These standards, issued under the Income-tax Act, provide frameworks for adjusting profits reported in financial statements to align with tax requirements in areas such as inventory valuation, revenue recognition, and fixed assets. The ICDS applies specifically to tax computation rather than the maintenance of general financial records.

Additionally, the department has outlined several mechanisms for tax dispute resolution. These include the Dispute Resolution Panel (DRP), which offers an alternative forum for taxpayers to object to draft assessment orders; the Mutual Agreement Procedure (MAP), which addresses cross-border disputes involving double taxation under Double Taxation Avoidance Agreements (DTAAs); and Safe Harbour Rules, which allow specified transfer prices to be accepted by tax authorities under certain conditions.
