India engages in multiple World Trade Organization disputes
India is involved in two distinct legal proceedings at the World Trade Organization (WTO). First, India, alongside 17 other nations including the US, UK, and China, has reserved the right to participate in a WTO dispute brought by Russia against the European Union. Russia alleges that the EU’s Carbon Border Adjustment Mechanism (CBAM) creates trade barriers and functions as an export subsidy. The WTO Dispute Settlement Body has agreed to establish a panel to review the CBAM package.
Separately, India has rejected a counter-notification from Australia regarding India’s sugar market price support. Australia claims India has exceeded the 10% de minimis limit for sugar subsidies for the past 11 years. India maintains that the notification lacks a proper basis, asserting that sugar purchases are conducted by private companies rather than government or state agencies. This follows previous disputes where a 2021 WTO panel found India’s sugar support measures inconsistent with its obligations, a decision India has appealed.
