India GST Council proposes major compliance and enforcement reforms
The GST Council has recommended several significant reforms to the Goods and Services Tax system aimed at reducing the compliance burden on businesses and altering enforcement protocols.
On the enforcement front, the Council recommended omitting Section 69 of the CGST Act to withdraw arrest powers and increasing the monetary threshold for criminal prosecution from ₹1 crore to ₹5 crore. These measures require formal amendments by Parliament and state legislatures to become law.
Compliance reforms scheduled for implementation starting November 1, 2026, include automated refund sanctioning for applicable cases and a proposal allowing e-commerce sellers to declare platform warehouses as their principal place of business in states where they lack a physical presence. Additionally, the Council approved an alternative filing mechanism for B2C businesses with annual turnovers below ₹5 crore, allowing for annual returns and quarterly tax payments. Late fees may also be waived for small traders with turnovers up to ₹5 crore who file returns within the same calendar month.
Further structural changes are expected, including the release of revised GSTR forms for public consultation, which are slated to take effect on April 1, 2027.
