India GST: Legal clarifications on appeals, pre-deposits, and merits
Recent legal developments and administrative clarifications in India have addressed several critical aspects of Goods and Services Tax (GST) appeals.
The Central Board of Indirect Taxes and Customs (CBIC) issued Circular No. 259/05/2026-GST, clarifying rules for pre-deposits. The circular specifies that while admitted liabilities must be paid in full, pre-deposits are calculated only on disputed tax. Appeals to the Appellate Authority require a 10% deposit of disputed tax, with an additional 10% required for the Appellate Tribunal stage. Furthermore, the CBIC noted that refunds of pre-deposits cannot be withheld simply because the Department intends to appeal, unless a favorable order is stayed.
In judicial rulings, the High Court of Tripura determined that merely uploading a GST order to a portal does not automatically trigger the appeal timeline if the order was not effectively communicated to the taxpayer through other modes. This decision restored an appeal for M/s Gandacherra Bricks Industries after the taxpayer learned of an order only upon applying for a tax clearance certificate.
Additionally, the Thane Bench of the Goods and Services Tax Appellate Tribunal (GSTAT) ruled that appeals cannot be dismissed for non-prosecution. The tribunal held that authorities must examine the merits and evidence of a case, even if an appellant fails to attend a personal hearing, to ensure reasoned orders are passed.
