India judicial updates on POCSO Act sentencing and verdicts

Legal developments regarding the Protection of Children from Sexual Offences (POCSO) Act have been highlighted in recent Indian court proceedings. The Gauhati High Court recently modified a sentence in a rape case, setting aside a 20-year POCSO conviction because the prosecution failed to prove the victim was under 18. However, the court upheld a 12-year sentence for rape under the Indian Penal Code, noting that the act of rape was proven despite the age discrepancy.

In Gujarat, state government data reveals that courts delivered 1,785 POCSO verdicts between 2022 and August 2026. During this period, 908 accused individuals received life imprisonment and 16 received death sentences. Officials noted an increase in the volume of judgments and a push for faster trials through fast-track courts. In one instance in Kalol, a special court sentenced a man to life imprisonment within 72 hours of a chargesheet being filed.
