India Overhauls Overseas Investment Rules with 2022 FEMA Reforms
The Foreign Exchange Management (Overseas Investment) Rules, 2022 were issued on 22 August 2022, replacing the earlier 2004 and 2015 regulations governing Indian residents’ overseas investments. The new framework consolidates provisions, expands the scope of permissible investments and shifts from prior‑approval requirements to post‑transaction accountability, aiming to reduce compliance burdens and foster outward foreign remittances.
The reforms are part of a broader deregulatory drive by the Indian government to dismantle legacy controls, streamline procedures and encourage commercial activity abroad. By moving away from a control‑oriented model, the rules seek to facilitate legitimate overseas investments rather than impede them.
