India: Protecting business logos through trademark registration
In India, business logo registration is a critical legal process conducted under the Trade Marks Act, 1999. Registering a logo as a trademark provides owners with exclusive rights to use the mark and enables legal recourse against infringement.
A logo may consist of a word mark, a device mark (graphic or symbol), or a combination of both. India also recognizes sound marks and specific color combinations as registrable trademarks.
Legal protection under Sections 134 and 135 of the Act allows for civil and criminal action against those using identical or deceptively similar marks.
