India Supreme Court rules number‑plate masking is only a traffic violation, not cheating

The Supreme Court of India set aside a criminal cheating case against Mohammed Abdul Ahad Shaker, who was stopped in Hyderabad in 2020 for riding a Honda Activa with the rear number plate covered by a black mask. The Court held that concealing a vehicle’s number plate may breach the Motor Vehicles Act, but it does not satisfy the essential ingredients of cheating under Section 420 of the Indian Penal Code. The bench of Justices Sanjay Karol and Augustine George Masih noted the lack of dishonest intent, inducement, or wrongful gain, and therefore quashed the pending cheating charge while leaving the regulatory violation intact.

The decision overturns a Telangana High Court ruling that had refused to quash the case, clarifying that police apprehension alone cannot elevate a traffic offence to a criminal cheating offence. The judgment provides guidance for future enforcement of vehicle‑identification regulations across India.
