India: Various legal rulings and investigations regarding GST compliance

Recent legal developments and investigations in India highlight ongoing enforcement of Goods and Services Tax (GST) regulations. The Goods and Services Tax Appellate Tribunal (GSTAT) Lucknow Bench has issued several rulings regarding penalties and documentation. In one instance, the tribunal ruled that penalties under Section 129 cannot be imposed on an entire consignment if only a portion of the goods is undocumented. Conversely, the tribunal upheld a penalty of Rs. 39,74,712 against a transporter for failing to produce valid e-way bills for garments, rejecting claims of accidental document swaps. Additionally, the tribunal noted that the mere production of invoices and e-way bills does not prove lawful transportation if physical discrepancies in weight or loading locations exist.

In judicial developments, the Delhi High Court ruled that GST penalties imposed without being proposed in a show-cause notice can be challenged through statutory appeals. Meanwhile, in Assam, the GST Intelligence and Enforcement Unit is investigating Bhagya Traders for allegedly defrauding the government of Rs. 5.34 crore through the use of fake Input Tax Credit (ITC) from suspected fraudulent taxpayers.
