Indian High Courts issue landmark legal rulings in July 2026
The Calcutta and Allahabad High Courts issued several significant legal rulings in July 2026.
In a case involving Agniveer recruitment, the Calcutta High Court directed the Special Intensive Revision (SIR) Appellate Tribunal to expedite an appeal for a candidate whose name was removed from the voter rolls. The court noted that electoral rights are fundamental to democratic governance and that deletions must strictly follow the Representation of the People Act, 1950.
The Allahabad High Court addressed multiple criminal law matters. It ruled that sniffer dog evidence is insufficient for conviction without a complete tracking record in the Panchnama and corroborating testimony from the dog handler. Additionally, the court clarified that a doctor's certificate stating a patient was "conscious" and "able to speak" is enough to validate a dying declaration, even without a specific "fit state of mind" endorsement, noting that the ultimate test is whether the declaration is voluntary and truthful.
Furthermore, the Allahabad High Court dismissed a Public Interest Litigation seeking to recall the bail of a murder convict and addressed the scope of the Places of Worship Act regarding state acquisitions.
