Indian High Courts issue rulings on civil suit amendments and election disputes

The Gujarat High Court has upheld a decision to reject a plaint amendment that sought to include compensation from cheque dishonour proceedings, interest, and legal expenses into an existing civil recovery claim. Justice Maulik J. Shelat ruled that compensation awarded in criminal proceedings must be recovered through the procedures prescribed under criminal law, noting that the additional claims rested on a different cause of action.

In a separate matter, the Himachal Pradesh High Court dismissed a petition seeking to reject a lawsuit challenging the election of a cooperative society's managing committee. Justice Virender Singh clarified that when deciding an application for rejection of a plaint under Order VII Rule 11 of the Code of Civil Procedure, courts must limit their examination to the averments in the plaint and accompanying documents, without considering the arguments or defences raised by the defendants.
